Precision Growth Capital is a loan broker and consultant, not a lender. We do not make loans or credit decisions. We connect qualified manufacturers with SBA-approved lenders and assist in the application process.

Not Affiliated with the SBA

Precision Growth Capital is not affiliated with, endorsed by, or sponsored by the U.S. Small Business Administration (SBA). The SBA is a federal agency that guarantees loans made by approved lenders. Information we provide about SBA programs is for educational purposes and may be subject to change based on SBA policy updates.

Fee Structure

We operate on a no-success, no-fee basis. You pay nothing unless your loan is approved and funded. Our fees are performance-based, typically ranging from 2-3% of the funded loan amount, and are disclosed in writing before you engage our services.

In most cases, our fees can be financed into your loan, meaning you do not pay out of pocket at closing. Specific fee arrangements will be detailed in a separate engagement agreement.

Client Responsibilities

By using our services, you agree to:

• Provide accurate, complete, and truthful information in all applications and communications
• Promptly provide requested documentation
• Notify us of any material changes to your business or financial situation during the application process
• Not misrepresent your business, financials, or eligibility for any loan program
• Comply with all applicable laws and regulations

Providing false or misleading information may result in termination of services, loan denial, and potential legal consequences.

Confidentiality

We treat your business and financial information as confidential. We will only share your information with lenders and third parties as necessary to process your loan application, as described in our Privacy Policy, or as required by law.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Precision Growth Capital or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Limitation of Liability

To the fullest extent permitted by law, Precision Growth Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business opportunities, or data, arising from your use of our services or website.

Our total liability for any claim arising from these Terms or our services shall not exceed the fees paid by you to us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our website will be uninterrupted, secure, or error-free, or that any information provided is accurate or complete.

Indemnification

You agree to indemnify, defend, and hold harmless Precision Growth Capital, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

You may terminate your engagement with us at any time by providing written notice. If your loan has not yet been funded, no fees will be owed.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any engagement agreement, constitute the entire agreement between you and Precision Growth Capital regarding our services and supersede any prior agreements or communications.
